Do you need to file a dog bite claim?
What are the laws regarding liability in Newark NJ?
These are just a couple of the many questions we are asked when it comes to dog bite law. Like other laws, dog bite laws and liability differs from state to state. New Jersey is a statutory strict liability state. This is common in many U.S. states. What this means is that the owner of the dog is legally liable to the victim who was bitten. As a general rule in these states, a dog doesn't get a "free bite". One bite is all it takes, it does not usually matter the "history" the dog has. This does not mean that all cases will have the same outcome however. Statutes of cities and states vary greatly.
According to New Jersey Law:
"The owner of any dog which shall bite a person while such person is on or in a public place, or lawfully on or in a private place, including the property of the owner of the dog, shall be liable for such damages as may be suffered by the person bitten, regardless of the former viciousness of such dog or the owner’s knowledge of such viciousness."
To recover, it must be proven:
1. That the defendant is the owner of the dog and was the owner at the time of the incident
2. That the plaintiff was on or in a public place or lawfully on or in a private place, including the property of the defendant and
3. That this location, established above, was where the bite took place
Understanding all your rights and responsibilities can be overwhelming, and other factors may also impact the outcome of your case. For this reason, it is important that you contact an attorney familiar with the laws in your area to assist you.
